A Grant of Probate is a court order giving executors appointed in a will the legal right to administer the estate of someone who has died. A Grant of Letters of Administration is a court order giving a family member (or creditor) the legal right to administer the estate of someone who has died without having made a will.  In order to obtain either Grant the Executor(s) or family member will need to deal with both legal and financial elements of someone’s estate.  Once the Grant has been issued the assets of the estate can be realised and distributed according to the Will or the intestacy rules as the case may be.

It is very important that the Executor(s) understands their responsibility as they are personally liable if any mistakes are made.
